| Tax Status |
If all employees pay 100% of the premium for their LTD benefit, benefits received upon
disability will be paid on a non-taxable basis. Otherwise, LTD benefits are taxable. |
| Definition of Disability |
During the elimination period and for the duration of the own occupation period
specified in the contract, the employee will be considered totally disabled if, solely as a
result of a disease or accidental injury:
- The employee is limited from performing the material and substantial duties of their
regular occupation; and
- There is a 20% or more loss in the employee’s indexed monthly earnings due to the
same disease or injury.
After the above-mentioned period, a disability caused by an accident or illness that
renders the employee totally incapable of pursuing any gainful occupation for which
they are reasonably suited by education, training or experience, regardless of the
availability of employment. |
| Primary Direct Offsets |
LTD benefits will be reduced by Workers’ Compensation, CPP/QPP (primary benefits
only), Criminal Injuries Compensation, and provincial no-fault auto plan benefits. |
| 85% All Source Maximum |
LTD benefits will be further reduced by the amount by which an employee’s income
from all sources exceeds 85% of his NET pre-disability earnings, if the LTD benefit is
non-taxable, or 85% of his GROSS pre-disability earnings, if the LTD benefit is taxable. |
